These terms apply to the Trust Ready website, the free trust check, the free templates and the Trust Ready subscription. By using them you agree to these terms.

Trust Ready is not a law firm

Trust Ready is not a law firm, an accounting practice or a financial adviser, and it does not give legal, tax, accounting or financial advice. Using the website, the check or the subscription does not make us your lawyer or adviser.

Trust Ready is a record keeping tool that supports trustees with the administration and compliance of their trust: a secure place for the trust’s records, reminders of common due dates, templates and plain English guides. All of it is general in nature. It does not take account of your trust deed or your circumstances, and it cannot tell you whether your trust meets its legal obligations.

Your responsibility as a trustee

  • You, as trustees, remain responsible for your trust and for meeting its legal, tax and other obligations.
  • You must do your own due diligence on what your trust requires and when, including reading your trust deed, and get advice from a lawyer or accountant where you need it.
  • Due dates and reminders are a guide only. They are based on the information you give us and on general rules, they may not cover every obligation that applies to your trust, and the actual dates can differ. A reminder that is missing, late or wrong does not change what you are required to do.
  • A score from the trust check is based only on your answers. A good score does not mean your trust is in order.

Trust Ready takes no responsibility for your trust’s compliance. Using Trust Ready does not mean your trust is compliant with the Trusts Act 2019, the Income Tax Act 2007, Inland Revenue requirements, your trust deed or any other law or obligation. Any failure by a trust or its trustees to comply, and any consequence of it, remains the responsibility of the trustees.

The trust check

The score and the list of items are based only on your answers to ten questions. A good score does not mean your trust is in order, and a low score does not mean you have done anything wrong. It is a starting point.

The templates

You can use the templates for your own trust, or for trusts you look after for clients. Check that anything you produce suits your trust deed before you sign it. You are responsible for the documents you create and sign.

Limits on our responsibility

We take care to keep Trust Ready accurate and working, but we cannot promise it is complete, up to date or free of errors, or that it will always be available.

To the extent the law allows, Trust Ready is not responsible or liable for any loss, cost, penalty, tax, interest or claim that comes from using or relying on the website, the check, the templates, the guides, the reminders or the subscription, or from anything you do or do not do as a trustee. This includes any compliance issue, breach of duty, missed filing or deadline, penalty, or claim by a beneficiary, Inland Revenue or anyone else in connection with your trust. If we are found liable despite this, our total liability is limited to the subscription fees you paid in the 12 months before the claim.

Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be excluded by agreement.

Your Trust Ready subscription

  • Price. $19.99 a month in New Zealand dollars. Trust Ready is not registered for GST, so no GST is added.
  • Billing. You pay by card through Stripe. The first month ($19.99) is charged when you subscribe. After that, $19.99 is charged on the 20th of each month, starting on the 20th of the month after you subscribe. We will tell you at least 30 days before any price change.
  • Cancelling. Cancel any time from your account page. There is no contract and no cancellation fee. You keep full access until the end of the month you have paid for, and we do not refund part months.
  • After you cancel. Your trust records stay readable and downloadable, but cannot be changed. You can subscribe again at any time, or delete your account and records.
  • Your records. What you put into Trust Ready is yours. You are responsible for what you record and for keeping your password and your email account secure.
  • Fair use. Use Trust Ready for real trust records. Do not upload anything unlawful or anything that is not yours to store.
  • If we close. If we ever stop running Trust Ready, we will give you at least 60 days notice to download your records.
