What trustee minutes are for
Minutes are the written record of a trustee meeting: who was there, what was discussed, and what was decided. Unless your trust deed says otherwise, trustees must act unanimously, so the minutes should show that every trustee agreed to each decision.
Good minutes matter most when something is questioned later, by a beneficiary, Inland Revenue, or a court. A decision that was never written down is hard to prove.
Tips
- Write the minutes at the meeting or straight after, not from memory months later.
- Start each resolution with the decision itself, for example “The trustees resolved to distribute $5,000 to Sam Taylor.”
- Have every trustee sign and keep the signed copy with the trust records.
- Check your trust deed for any rules about meetings, notice or how decisions are made.
